Emmet County Sheriff Mike Martens reports that on at 0631 am on 10-09-2012 the sheriff's office received a call reporting that an assault had occurred at 305 1st Ave. in Armstrong. The Emmet County Sheriff's Office and Armstrong Police Department responded to this location and upon investigation learned that two women had been assaulted at this location by 24 year old Joshua McFadden of Sheldon, Iowa. Mc Fadden who had left the scene prior to the officers arrival allegedly assaulted his girlfriend Alyssa LePaige age (23) of Sheldon at approximately 430 am this same morning and then assaulted his mother at 530 am. Upon completing the investigation at the scene LePaige was placed under arrest in connection with two outstanding arrest warrants from Lyon County, Iowa. Law enforcement officers from both agencies went to 106 South 4th Ave. in an attempt to locate McFadden. Upon making contact with a resident of the house, entry was gained and McFadden was located. McFadden was placed under arrest in connection to the assaults on both women and in connection with outstanding arrest warrants from Lyon County as well. While Officers were in the home they observed what was believed to be drug paraphernalia. As a result of this the residents of the home (35) year old Chad Frietag and 40 yr. old Beth Vogt were placed under arrest for possession of drug paraphernalia. All four subjects were transported and processed into the Emmet County Jail. The sheriff's office applied for a search warrant for the home which was granted. A complete search of the home was then conducted and additional items of drug paraphernalia and controlled substances were located.
McFadden was charged with two counts of Domestic Abuse by Strangulation, a class (D) felony each, two counts of Willful Injury, a class (D) felony each, 1 count of possession of prescription drugs, a serious misdemeanor, one count of possession of drug paraphernalia, a simple misdemeanor and one count of Obstruction of Emergency Communications a simple misdemeanor. Both Freitag and Vogt are each charged with one count of possession of prescription drugs and one count of possession of drug paraphernalia.
A Class (D) Felony carries a maximum of 5 years in prison and a fine of not more than $7,500. A Serious Misdemeanor carries a maximum jail sentence of one year and/or a fine of not more than $ 1875.00 A simple misdemeanor carries a maximum jail sentence of 30 days in jail and/or a $625.00 fine. McFadden remains in the Emmet County Jail under a bond of $40,950.00 cash or surety, and bond on Freitag and Vogt was set at $1950.00 cash or surety during each of their initial appearances in front of the Emmet County Magistrate.
