Estherville man charged with sexual abuse

According to Emmet County court records, 23-year-old Austin Mitchell was charged on Nov. 22nd with four counts of third degree sexual abuse, a class C felony. Judge David Forsyth issued the warrant Nov. 23, and Mitchell was taken into custody that day.

The Iowa Code states sexual abuse in the third degree ?occurs when the person performs a sex act by force or against the will of the other person. Mitchell is charged under several subsections of Iowa Code 709.4 within the four counts.

The alleged incidents occurred between May 31 and Aug. 31 of this year at an Estherville residence.

Mitchell is scheduled to be arraigned on December 19th at 9:30 a.m. at the Emmet County Courthouse.

A no-contact order was also served on Nov. 23.

Mitchell was released from custody after posting a $10,000 cash only bond.
